| We’ve all seen the TV shows and movies that show people getting arrested. Invariably they are read their Miranda rights: You have the right to remain silent, you have the right to consult an attorney, anything you say can and will be used against you…. But if you’ve just been arrested for a DUI or DWI, you may have been surprised that you were probably not read those rights at all! Is this legal? As it turns out, Miranda rights do not need to be read for a valid arrest. They DO have to be read when the officer or investigator wants to find admissible evidence against you after you have been arrested. Many people who are arrested for DUI or DWI have no idea what their rights are. Prior to being arrested, the officers can gather all the oral evidence they want, so watch what you say. You can ALWAYS ask to consult with your lawyer before answering any questions and before taking any sort of BAC or field sobriety test. Consult a Baltimore DUI attorney with experience handling DUI cases.
